Terms of Use – Dollar Recipe Club LLC

These Terms of Use (“Terms”) are important to your use of the Dollar Recipe Club LLC website and access to the recipes. The Terms represent a binding agreement between you and Dollar Recipe Club LLC – prevailing over any previous understandings, promises, and covenant concerning the website and services.

You must review and agree to the Terms. By subscribing and accessing our recipes or otherwise using any features on our website, you warrant that you have reviewed, understand, and agree to be bound by these Terms. If you do not agree to the Terms, you should immediately stop your use of our services.

Eligibility
To create an account and access our recipes, you must meet the requirements below:

You must be at least 18 years of age (or the legal age of majority in your jurisdiction);
You must be capable of entering into a binding contract such as these Terms; and
Your use must not violate any applicable laws.

By subscribing to our services, you confirm that you meet all the above requirements. We reserve the right to refuse you our services, terminate your account, or cancel your subscription if we believe that you do not meet these eligibility requirements or have violated any part of these Terms.

Account Registration
To subscribe and access our recipes, you must first create an account and submit identifying information, including your name and email address. You agree to provide accurate, current, and complete information about yourself as prompted during the registration process and you agree to update your information when there are changes to it. You agree that failure to provide accurate information may result in the suspension or termination of your account and access to our recipes.

You further agree to the following terms regarding account registration:

You are responsible for maintaining the confidentiality of your account credentials, especially your password. You are fully responsible for all activities that occur under your account. We recommend choosing a strong password and changing it periodically to ensure the security of your account. You must not share your login details with anyone or allow others to access your account. That is a violation of these Terms.

You agree to immediately notify us at info@dollarrecipeclub.com if you suspect any unauthorized access to or use of your account. You also agree that we are not liable for any losses or damages resulting from unauthorized use of your account due to your failure to secure your credentials.

You agree that we reserve the right to suspend or terminate your account at any time, with or without notice, and without refund (where applicable) if we believe you have violated these Terms, provided false information, engaged in fraudulent or illegal activities, or misused our services. The termination of your account may result in the loss of access to your saved recipes and any associated content.

Privacy Policy
By using our services, you agree to our Privacy Policy, which describes the information we collect when you use our services, including how we collect, use, disclose, retain, secure, and generally handle that information. It also describes the rights applicable laws have provided you.

If you do not agree to how we use your information as described in our Privacy Policy, you must immediately stop using our services.

Subscription and Payments
Our service is subscription-based, allowing you to access and save recipes by paying periodic (monthly or yearly) fees. By subscribing to access our recipes, you hereby agree to the following terms regarding payments, billing, and subscription management:

Subscription plans. We provide both monthly and yearly subscription options. For a fee of $1 per month or the equivalent yearly rate, you can access our recipes without restriction, including saving them to your profile. Our subscription fees are subject to change, and any adjustments will be communicated to you in advance.

Free trial. We provide you with a 14-day free trial, allowing full access to our recipes for 14 days starting from when you first subscribe. At the end of the trial period, your subscription will automatically renew, and you will be charged the applicable subscription fee unless you cancel before the trial ends. Please ensure you cancel your subscription before the end of the 14th day if you do not wish to continue, as we do not offer refunds at that point.

Payment processing. We process your subscription securely through Stripe, our third-party payment provider (except where you use another payment method, such as a promo code). By subscribing, you authorize us and Stripe to charge the subscription fee to your designated payment method. You warrant to us that you own the payment method submitted or that the owner permits you to use it. You further warrant that your payment method contains sufficient funds to cover the subscription fees.

Failed payments. If a payment is declined or fails for any reason, you will be notified, and we may attempt to process the payment again. If payment continues to fail, we reserve the right to suspend or terminate your access to the service until the outstanding fees are paid.

Auto-renewal. You hereby agree that your subscription will automatically renew at the end of each billing cycle (monthly or yearly) unless you cancel before the renewal date. You will be charged the current subscription rate at the time of renewal. By agreeing to these Terms and initiating a subscription, you authorize automatic billing until you cancel your subscription.

Promo codes. From time to time, we may offer promotional codes that provide discounts on subscriptions. Promo codes must be applied during checkout and are subject to expiration and other terms specified in the promotion.

Cancellation. You may cancel your subscription at any time by logging into your account and following the cancellation instructions. If you cancel your subscription before the end of your billing period, you will retain access to the service until the current billing cycle ends. You are aware that refunds are not issued for partial months of service.

Taxes. Subscription fees are exclusive of taxes. If required by applicable law, we will collect taxes based on your billing address, which may include state and local sales tax. You are responsible for ensuring your billing address is accurate and up to date for tax purposes.

Refund policy. You are aware and agree that Dollar Recipe Club LLC does not offer refunds for subscription fees, except as required by law. Any exceptions to this policy will be considered on a case-by-case basis and are at our sole discretion.

Prohibited Uses
By using our website, you agree not to engage in the following activities:

Sharing, distributing, selling, or exploiting any content from our services, including recipes, for commercial purposes or public display without permission.

Attempting to gain unauthorized access to the website, servers, or databases, including by hacking, password mining, or bypassing security measures.

Attempting to reverse-engineer, decompile, or disassemble any part of our website or software.

Using bots, scripts, or other automated tools to access, collect, or scrape data from the website.

Copying, modifying, or redistributing any content without proper authorization, as all content is for personal use only.

Bypassing payment systems, abusing promo codes, or creating multiple accounts to exploit our free trial.

Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

Content Access and Restrictions
We provide users access to a range of recipes and related content. By using our services, you agree to the following terms regarding the use of content and applicable restrictions:

Intellectual Property Rights. All content provided through our website, including without limitation, our recipes, text, design elements, logos, and trademarks, is our exclusive property and is protected by copyright, trademark, and other intellectual property laws in the US and other locations. You acknowledge that all rights, title, and interest in the content remain with us or respective licensors.

Limited license. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the content for your personal, non-commercial use only.

Restrictions on use. You agree not to (i) modify, copy, reproduce, distribute, or create derivative works of any content from our website; (ii) use any content from our services in a way that infringes on our intellectual property rights or the rights of others; or (iii) share or transmit content outside our services without proper authorization.

Content availability. We may, at any time, add, remove, or modify recipes and content on our services. We do not guarantee the availability of any particular recipe or content at any given time.

Modifications to Services
We reserve the right to modify, update, or discontinue any part of our services or website features at any time, without prior notice. This includes changes to available recipes, subscription plans, pricing, or the overall design and functionality of the website. We may also remove or alter content as needed to improve our services or align with business needs.

While we may make modifications to our services, we will make an effort to notify you of any significant changes that could impact your use of our website. Notifications may be sent via email or displayed as announcements on the website. However, we are not obligated to provide advance notice for all changes.

Termination of Terms
These Terms will remain in effect while you use our services or retain your account. You may terminate your account and subscription at any time by canceling through your account settings. Upon termination, you will no longer have access to our recipes.

You agree that we reserve the right to suspend or terminate your account, subscription, or access to our services at any time, with or without notice, if we determine that you have violated these Terms or engaged in any prohibited activities. Upon termination for such reasons, you will not be entitled to any refunds for any remaining subscription period.

In the event of termination, whether by you or us, all provisions of these Terms that are intended to survive termination, including intellectual property rights, disclaimers, and limitations of liability, will continue to apply.

Disclaimer of Service
We provide our services on an “as-is” and “as-available” basis. We make no warranties or representations, express or implied, regarding the availability, accuracy, completeness, or reliability of the content, recipes, or any other materials provided through our services. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use our services at your own risk, and we will not be liable for any damage to your computer system, loss of data, or any other harm that results from your use of our recipes.

No advice or information, whether oral or written, obtained from our website or through our services, shall create any warranty not expressly stated in these Terms.

Limitation of Liability
To the fullest extent permitted by law, Dollar Recipe Club LLC and its affiliates, officers, directors, employees, and agents will not be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of, or inability to use, our services.

In no event will our total liability to you for all claims arising from or related to the use of our services exceed the amount you have paid to us in the last twelve 2 years before your claim. This limitation applies to any claim based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If this applies to you, some or all of the above exclusions or limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Dollar Recipe Club LLC reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You will not settle any claim without our prior written consent.

By using our services, you consent to the jurisdiction of these courts and waive any objections to the venue or jurisdiction of such courts.

Any changes will be effective immediately upon posting the updated Terms on our website. We will notify you of significant changes by posting a notice on the website or by sending you an email.

The rights a user has over their account terminate upon their death. On the other hand, we may freely assign or transfer our rights and obligations under these Terms without restriction.

Force Majeure. If any event prevents us from discharging our obligations to you, such as natural disasters, acts of government, internet breakdowns, power outages, or other disruptions, we shall not be held liable for any liabilities that delay or non-performance.

Electronic Communications. By using our website and services, you consent to receive electronic communications from us, especially via your account email address. You agree that all agreements, notices, disclosures, and other communications provided electronically in connection with our services satisfy any legal requirement that such communications be in writing.
